(The following is a press release issued this afternoon by the Office of the State’s Attorney for Worcester County.)
SNOW HILL -- The Office of the State’s Attorney for Worcester County filed a criminal information in the Circuit Court for Worcester County charging Andre James Kaczynski, 47, of Ocean Pines, Maryland, with the following charges.
Counts 1 through 9 relate to a Dec. 16, 2011 motor vehicle crash which resulted in life threatening injuries to Ann Marie DelRicco and her 18-month-old daughter Ava DelRicco as well as the seizure of Phencyclidine (PCP) from Kaczynski’s motor vehicle.
Counts 10 and 11 relate to a search and seizure warrant that was executed on Dec. 22, 2011 at Kaczynski’s residence in Ocean Pines that resulted in the seizure of Phencyclidine (PCP) and Marijuana.
Kaczynski was originally charged for the Dec. 16, 2011 incident in the District Court of Maryland and held on a $100,000 bond. Kaczynski posted that bond on Dec. 19.
Kaczynski was also charged in the District Court of Maryland for the Dec. 22, 2011 incident. Kaczynski appeared before a Worcester County District Court Commissioner who held Kaczynski without bond after hearing evidence presented by the Office of the State’s Attorney.
Kaczynski was held without bond over the Christmas holiday, but was ultimately granted a $25,000 bond after being brought before a District Court Judge on Dec. 27, 2011.
The Circuit Court criminal information includes several additional charges including a count alleging that Kaczynski caused life-threatening injuries to Ann Marie DelRicco by motor vehicle while impaired by a controlled dangerous substance. As a result of the Circuit Court criminal information being filed, the two District Court cases will be forwarded to the Circuit Court and will be consolidated for trial on a date to be set by the Circuit Court.
State’s Attorney Beau Oglesby expresses great appreciation to the Ocean City Police Department and all those who diligently investigated this case. He also thanks the local community for their unwavering support of the DelRicco family. He adds that “the Circuit Court was clearly the more appropriate venue for this trial based on the seriousness of this case.”
The case will be prosecuted by Oglesby as well as Deputy State’s Attorney Abigail Marsh.
