City Council United Against Park Smoking

OCEAN CITY – The Mayor and City Council voted unanimously on first reading, with no discussion, to ban smoking in public parks and playgrounds.

The ordinance defines “environmental tobacco smoke” as the complex mixture formed from escaping smoke of a burning tobacco product or smoke exhaled by the smoker. “Smoking” means the burning of a lighted cigarette, cigar, pipe, or any other matter or substance that contains tobacco.

The ordinance reads, “It is the intent of the Mayor and City Council of Ocean City to protect the public and its employees from involuntary exposure to environmental tobacco smoke in certain areas open to the public.”

Public parks include Ocean Bowl Skate Park, Ocean City Tennis Center at 61st Street and Coastal Highway, and playgrounds in the following parks, Bayside Park (aka Downtown Recreation Complex), Robin Park, Little Salisbury Park, Northside Park, Gorman Park, and North Surf Park.

Any person who violates the law “shall be subject to ejection from the public park and be subject to a municipal infraction of up to $500.00, which can be issued by an employee of the Department of recreation and parks in addition to enforcers listed in this code.”

The smoking ban at public parks and playgrounds was originally discussed last December during a public hearing to ban smoking on Ocean City’s boardwalk, beach, and public parks. The council voted not to ban smoking on the Boardwalk or the beach. Instead, council officials decided to create designated smoking stations as an “educational step” for smokers.

During the hearing, Councilman Joe Hall said as far as the “kiddy parks” are concerned he proposed smoking be prohibited in those areas. He made a motion to create voluntary smoking areas on the beach and Boardwalk and restrict smoking in public parks. Councilman Doug Cymek seconded the motion and the council voted unanimously to approve it.

The anti-smokers commit flagrant scientific fraud by ignoring more than 50 studies which show that human papillomaviruses cause at least 1/4 of non-small cell lung cancers. Smokers and passive smokers are more likely to have been exposed to this virus for socioeconomic reasons. And the anti-smokers' studies are all based on lifestyle questionnaires, so they're cynically DESIGNED to blame tobacco for all those extra lung cancers that are really caused by HPV. And they commit the same type of fraud with every disease they blame on tobacco.

And, all their so-called 'independent' reports were ring-led by the same guy, Jonathan M. Samet, including the Surgeon General Reports, the EPA report, the IARC report, and the ASHRAE report, and he's now the chairman of the FDA Committee on Tobacco. He and his politically privileged clique exclude all the REAL scientists from their echo chamber. That's how they make their reports 'unanimous!'

For the government to commit fraud to deprive us of our liberties is automatically a violation of our Constitutional rights to the equal protection of the laws, just as much as if it purposely threw innocent people in prison. And for the government to spread lies about phony smoking dangers is terrorism, no different from calling in phony bomb threats.

Outdoor smoking bans are absolutely unnecessary in outdoor areas, beyond those covering areas children are in(i.e. playgrounds, by baseball diamonds, etc.). What's the point of this law, other than to foolishly jump on the politically correct trend to unnecessarily shame smokers, and 'de-normalize' smoking, till no legal indoor or outdoor spaces for smokers remain? Not to mention, some California communities are already approaching smoking with this level of unnecessary strictness on restricting where it's permitted, such as in 100% of residences that aren't single-family homes(i.e. Sebastopol, CA, and Belmont, CA), and sometimes in ALL outdoor sidewalks and outdoor public areas of a downtown(i.e. Calabasas, CA, Granbury, TX).

A very high number of studies on outdoor SHS/ETS exposure have been done in the past, and NOT ONE study has shown outdoor exposure is deadly. The ridiculous 'study' Bloomberg used to justify the recently passed NYC park smoking ban is clearly junk science, and there are no limits to how deceitful the anti-smoking movement has become. I applaud the Mayor and City Council for taking this first step towards banning smoking in public areas. Although, it does NOT take the ban far enough. Smoking in all public areas should be prohibited. It totally ruins the time spent at the beach, parks or boardwalk - there is no way to avoid the drifting smoke - not to mention the ugliness of a cigarette butt disposed of on the beautiful sand. On the boardwalk, vacationers are constantly dodging the smokers - maneuvering around them - judging the direction of the breeze to avoid breathing in the noxious fumes. I find myself and my guests avoiding the Ocean City Boardwalk for just that reason. The smell is overwhelming at times and the cigarette butts tossed on the boardwalk, wedged between the boards - is a sad visual of the boardwalk. Bethany Beach is so refreshing, I have found myself wandering to Bethany Boardwalk for just that reason - NO SMOKE! Smoking in the Parks, not just the playgrounds, should be banned - there are too many families, children and pets that are subject to the fumes. Again - the callousness of tossing the cigarette butts around destroys the beauty of the city. I urge the Mayor and City Council to take further action on a total smoking ban of all public areas.
