BERLIN — A Salisbury man was arrested on assault and other charges last weekend after allegedly scrapping with Maryland State Police troopers and urinating on the Berlin barrack sign following the arrest of an acquaintance on drunk-driving charges.

Around 3:30 a.m. last Sunday, Maryland State Police troopers made a DWI arrest during which a passenger was located in the vehicle. The passenger, later identified as Colby Lane Wolfensberger, 32, of Salisbury, was offered a ride to the MSP Berlin barrack to wait for a ride from a friend to his residence. According to police reports, Wolfensberger was extremely intoxicated and unable to drive any vehicle.

While waiting for a ride, Wolfensberger allegedly became combative, cursing civilians and MSP troopers who were coming and going from the barrack. At one point, troopers feared Wolfensberger was damaging police cruisers in the parking lot. Troopers exited the barrack and found that Wolfensberger had wandered close to Route 50 and was in danger of being struck by passing vehicles.

At that point, Wolfensberger allegedly kicked the MSP Berlin barrack sign before urinating on it. As troopers approached him, Wolfensberger allegedly began to swing at the officers. A struggle ensued and Wolfensberger was eventually subdued. He was arrested and charged with second-degree assault on a police officer, malicious destruction of property and resisting arrest.

Wolfensberger was taken to AGH for treatment of injuries sustained in the fight. Upon his release, he was taken before a District Court Commissioner and was ordered to be held on a $10,000 bond. One trooper was sent to AGH with minor injuries and was treated and released.

Shoplifter Nabbed

WEST OCEAN CITY — A Frankford, Del. woman was arrested on theft and other charges last week after a broadcast went out seeking her for shoplifting from West Ocean City outlet stores.

A little after 1 p.m. last Sunday, the Worcester County Sheriff’s Office was given a broadcast to be on the lookout for three suspects in a black vehicle leaving the White Marlin Mall in West Ocean City. The three suspects were wanted for questioning in regard to a shoplifting that had occurred at the Carter’s clothing store in the mall.

A Worcester County Sheriff’s deputy pulled over the suspected vehicle on westbound Route 50 after the driver threw a cigarette butt out of the window that landed on the patrol vehicle. The driver was identified as Shannon O’Hara Lee Irving, 23, of Frankford. Irving told the deputy her Delaware license was suspended. It was also determined she was driving a rental vehicle but was not allowed to per the rental agreement.

During the investigation, the deputy observed in plain view a pile of children’s clothes on the rear passenger side floor on which a Carter’s tag was seen. During a subsequent probable cause search, other clothes with tags on them were discovered and Irving had no receipts for any of the merchandize. Irving later admitted taking the clothing from stores without paying for them.

Several items were taken from Carter’s, Aeropostale and The Gap totaling over $450 in merchandize from all three stores.

Contractor Admits $5,000 Theft

WEST OCEAN CITY — A Belair man was charged this week with felony theft after allegedly swiping $5,000 from a West Ocean City residence while working as a contractor just before Christmas.

On Dec. 22, a Maryland State Police trooper took an initial report of a theft from a residence on Salisbury Rd. in West Ocean City. The investigation revealed a suspect or suspects had stolen $5,000 in cash from the residence sometime between December 16 and December 21. The Worcester County Bureau of Investigation (WCBI) took the lead on the investigation and determined an employee of a local HVAC company, later identified as Nicholas William Lupo, 24, of Belair, Md., had been in the residence doing work during the timeframe.

During a subsequent interview, Lupo ultimately gave a full confession to the crime. He was arrested last weekend and charged with theft over $1,000 but under $10,000.

Adult Abuse Sentence

SNOW HILL — A Berlin man arrested in June for sexually assaulting a vulnerable male adult over a period of three years was sentenced last week to 10 years in jail, most of which was suspended.

In June, Jason Paul Carpenter, 30, of Berlin, was arrested on multiple charges including first-degree assault, first-, second- and third-degree sex offense, vulnerable adult abuse, sodomy and perverted practice after his former girlfriend reported to police he allegedly sexually assaulted her mentally challenged brother several times over a period of three-plus years from January 2008 to May 2011.

The investigation revealed Carpenter allegedly performed sexual acts on the victim, who has the mental capacity of a third-grader, several times while living together with the victim’s sister in Berlin. According to police reports, Carpenter entered the victim’s bedroom while the victim was asleep and performed the sexual acts.

In November, Carpenter entered Alford pleas to abuse of a vulnerable adult and a second-degree sex offense and a pre-sentence investigation was ordered. For the second-degree sex offense, Carpenter was sentenced to 10 years in jail with all but 18 months suspended. He was also placed on supervised probation for five years upon his release.
